myNutratek Privacy Policy Statement

myNutratek respects your right to privacy and is committed to protecting your privacy. Our privacy policy statement is an important part of our continuing commitment to provide you with the best service. This privacy policy statement explains our online data collection and use practices with respect to our online site (the “Site”). BY ACCESSING THE SITE, YOU ARE CONSENTING TO THE INFORMATION COLLECTION AND USE PRACTICES DESCRIBED IN THIS PRIVACY POLICY STATEMENT.

Collection of Information

myNutratek collects two different types of information on the Site for three different purposes. First, the Site may automatically collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the type of browser and operating system used to visit the Site; the date and time you access the Site and which portions of the Site you visit; the pages that you access while at the Site and the Internet address of the Web site from which you linked directly to our Site. We collect this information passively through technology, such as cookies. myNutratek does not use this information to ascertain your personally identifiable information. This information is used to help improve the Site, analyze trends and administer the Site. Except where specified on the Site, you do not have to provide personally identifiable information to visit or download information from the Site. Unless you choose to make your personally identifiable information available to us, myNutratek does not collect such information from you.

Second, we collect certain information about you (“personally identifiable information”), which you disclose to us when you use services available on the Site. This may include contact data, like your name and email address, and demographic data, such as your gender, age, height, weight, school, eating habits and exercise frequency. For example, if you provide information about yourself when using the services available on the Site, such as information about your diet or exercise habits for the Health and Wellness Web Portal, that information will be stored on the Site. We collect information from children under 13 only in limited circumstances where we have obtained parental consent or where the child's school has made the Site available to its students and the child's school has provided the appropriate consent.

We may use the information we collect about you to create aggregate statistics about the Site's users. This aggregate information does not include identifying information about any individual. This non-personally identifiable information about our users is created for purposes such as measuring diet, health and fitness trends as well as demographics. myNutratek also collects and shares non-personally identifiable information with advertisers, service providers, and other persons with whom we conduct business.

Use of personally identifiable information

The personally identifiable information collected on this Site will be used to operate the Site and to provide the service(s) or carry out the transaction(s) you have requested or authorized. We may also use the information you provide to communicate with you about your account or transactions with us and to send you information about our Site and its features. In support of these uses, myNutratek may use personally identifiable information to provide you with more effective customer service, to improve the Site and any related myNutratek products or services, and to make the Site easier to use by eliminating the need for you to repeatedly enter the same information or by customizing the Site to your particular preference or interest. In order to offer you a more consistent experience in your interactions with myNutratek, information collected online may be combined with information collected by other myNutratek services.

myNutratek hires other companies to provide limited services on our behalf, such as web site construction and maintenance and information distribution. This privacy policy statement does not cover any third-party sites, including any third-party sites that may, from time to time, be linked to the Site or used to host specific pages on the Site. We will only provide these companies the personally identifiable information they need to deliver the service. They are required to maintain the confidentiality of the information and are prohibited from using that information for any other purpose.

myNutratek may disclose personally identifiable information if required to do so by law or in the good faith belief that such action is necessary to (a) conform to the law or comply with legal process served on myNutratek or the site; (b) protect and defend the rights or property of myNutratek; or (c) act in urgent circumstances to protect the personal safety of myNutratek employees or agents, users of myNutratek products or services, or members of the public.

Personally identifiable information collected on the Site may be stored and processed in the United States or any other country in which myNutratek or its affiliates, subsidiaries or agents maintain facilities, and by using the Site, you consent to any such transfer of information outside of your country.

Please be aware that this privacy policy statement and any choices you make on the Site will not necessarily apply to personally identifiable information you may have provided to myNutratek in the context of other, separately operated, myNutratek products or services.

myNutratek will not deliberately disclose any personally identifiable information provided by or collected from you to any third party except as set forth above. It is myNutratek's policy not to accept information from other parties that is confidential or proprietary unless subject to a written agreement. If you wish to retain the confidentiality of your material, do not submit it to us in any form unless subject to a written agreement. myNutratek may reproduce, disclose, transmit, broadcast or otherwise use any unsolicited ideas, without any obligation to compensate you.

Retention of Information

We retain information for as long as required, allowed or we believe it useful, but do not undertake retention obligations. We may dispose of information in our discretion without notice, subject to applicable law that specifically requires the handling or retention of information. You must keep your own, separate back-up records. You may permanently delete and purge your health-related personally identifiable information from the Service; backup copies may exist for a short time in our databases.

No Spamming or “Phishing”

Under no circumstances will myNutratek contact you via spam or mass e-mail or telephone to obtain personally identifiable information. myNutratek may contact you via e-mail regarding a specific inquiry you make or to conduct other general surveys.

Children's Privacy

myNutratek is committed to protecting the privacy of its users, and takes further privacy protections when personal information is collected from children under the age of 13. myNutratek may collect information from children under the age of 13 in limited circumstances where the child's school has provided its students with access to myNutratek. The Children's Online Privacy Protection Act requires that we inform parents and legal guardians about how we collect, use and disclose personal information of children under 13 years of age; and that, in certain circumstances, we obtain consent of parents and guardians in order for children under 13 years of age to use certain features of our Site. Use of the term “parent” in this section includes legal guardians.

If your child is under 13 and uses the Site, we will ask for your permission to allow your child to use the Site. In certain circumstances where your child has access to, and uses our Site through a school-sponsored program, the school may assist us in obtaining your consent or we may rely on the school to obtain your consent to your child's use of the Site. We will collect and use your child's information as outlined in this Privacy Policy. If a parent refuses to allow a child to participate in the Site, we delete the child's information on our Site and require the child's school to no longer make myNutratek available to that student. We collect and use only the amount of information about your child that is reasonably necessary to allow your child to use the functions and services available on the Site. If your child is using the Site through a school-sponsored program, we may share the information collected about your child with the school.

Parents can, at any time, refuse to permit us to collect further personal information from their child and can request that any personal information we have collected be deleted from our Site and database. A parent can access, change or delete his or her child's personal information by using the child's account information and logging in directly to the Site or can contact our Account Services department to access, change, or delete the personal information that we have collected from his or her child by sending an email to accountservice@mynutratek.com. Data security and quality

myNutratek is committed to data security and the data integrity of personally identifiable information available from or collected on the Site. myNutratek has taken precautions to protect personally identifiable information from loss, misuse, or alteration. Any authorized third parties responsible for this information are committed to the same principles, and are required by contract to follow the same policies and guidelines as myNutratek in protecting this information. You should be aware, however, that even though protections are in place, myNutratek cannot guarantee against the occurrence of hardware failure, unauthorized intrusion, or other technical problems.

Our secure servers protect your information using encryption throughout the ordering process. myNutratek uses a standardized universal Internet technology called Secure Socket Layer (SSL) encryption in connection with certain personally identifiable information collected on the Site. When you send information from your computer to our servers at the Site it is encrypted (locked) so that the information is protected during its transmission. Most browsers will show a lock icon in the bottom status bar on secure pages. Look for this icon on the web pages that ask for credit card or other sensitive information.

Procedures for Access to view or correct personally identifiable information

Unless otherwise prohibited by applicable law or regulation, an individual may access and correct personally identifiable information whether or not the inaccuracy was created by accident, unauthorized access, or a change in circumstances. myNutratek also reserves the right to use any legally appropriate measures to prevent, monitor, and investigate any attempt to deface, delete, or otherwise tamper with or abuse the Site, servers, databases, information systems, or other myNutratek technology assets. myNutratek reserves the right to change this privacy policy statement at any time to reflect changes in its business practices. If myNutratek elects to change its business practices in a way that implicates this privacy policy statement, such changes will be promptly reflected on the Site.
